With the cost of gasoline on the rise, people are looking for less expensive
means of transportation; others prefer a trendy and fun method for zipping
around town! This may lead to an increase in the use of motorized scooters, pocket motorcycles (also
known as “miniature motorcycles” or “pocket bikes”)
and Segways (also known as “self-balancing electric
scooters” or “electric personal assistive mobility
devices”). We’ve noticed a variety of approaches that
municipalities have used to balance the use of these
devices against the safety of pedestrians and motor vehicles. Some municipalities prohibit the use of
motorized scooters and pocket motorcycles on streets
and sidewalks. We have a sample law that restricts the
operation of Segways to designated bicycle paths and
private property but prohibits the business of leasing
or renting Segways. Other municipalities require
express written permission prior to operation of these devices, and riders must
comply with a list of conditions (including use of a helmet). Exceptions are
made for handicapped persons. |

Chapter 168
ARTICLE VI
Vehicles Prohibited from Public Streets
[Added 10-12-2004]
§ 168-33. Definitions and interpretation.
All terms used in this article shall be interpreted in accord with the definitions thereof set forth in C.G.S. Title 14, as that title may be amended or recodified from time to time, except that the following defined terms shall have the meaning indicated herein:
MOTORIZED SCOOTER -- A wheeled device other than a motor vehicle consisting of a platform of metal, wood, plastic or any other material designed for recreational purposes to carry its user in an erect position and which is propelled by the use of a small motor. The term "motorized scooter" shall not be construed to include either: a wheelchair or any similar device used to provide transportation for any disabled person; or a "Segway" or any similar device used to provide transportation for any person who possesses a valid motor vehicle operator's license.
POCKET MOTORCYCLE -- A two-wheeled vehicle other than a motor vehicle, bicycle with helper motor or a motorized scooter and which is propelled by an internal combustion engine, electric motor or other mechanical means; is capable of carrying a rider and/or passenger at a speed in excess of five miles per hour; and is designed to replicate the general appearance of a motorcycle, regardless of the scale of the replication.
§ 168-34. Use of public streets prohibited.
A. No person may operate any motorized scooter or pocket motorcycle within the limits of any public street.
B. No person may ride as a passenger in or upon a motorized scooter or pocket motorcycle within the limits of a public street.
C. In addition to the issuance of a citation, any police officer who observes a violation of this section may take the pocket motorcycle or motorized scooter in question into the custody of the West Hartford Police Department or have it towed to a storage facility at the owner's expense, to be held until such time as adequate arrangements are made by a responsible adult for it to be transported to an appropriate location. If no such arrangements are made within 72 hours, said pocket motorcycle or motorized scooter shall be deemed to be abandoned.

Chapter 98
MOTORIZED PASSENGER DEVICES
[HISTORY: Adopted by the Annual Town Meeting of the Town of Nantucket 4-12-2004 by Art. 54, approved 9-3-2004. Amendments noted where applicable.]
§ 98-1. Prohibited absent express written permission.
No person shall operate a motorized scooter, motorized skateboard, Segway, or other similar device (hereinafter referred to as "personal motorized passenger devices") on any Town-owned or -controlled public way, sidewalk, park, playground or beach without the express written permission to do so from the Town official(s) or officer having jurisdiction over the use of said Town property or their respective designee (hereinafter referred to as the "authorizing official"). The following vehicles shall be exempt from the provisions of this chapter:
A. Vehicles or motorized passenger devices licensed by the Commonwealth of Massachusetts as motor vehicles or otherwise to the extent authorized by the Commonwealth or the United States for such operation;
B. Vehicles or motorized passenger devices licensed or used by the federal government or any federal agency, instrumentality or entity, including the United States Postal Service, performing a service to the public;
C. Personal motorized passenger devices used by handicapped persons;
D. Personal motorized passenger devices used by public safety personnel, including police officers;
E. Landscaping equipment;
F. Golf carts.
§ 98-2. Conditions on grant of written permission.
A. Any grant of written permission to use a personal motorized passenger device issued by the authorizing official shall include the following conditions/restrictions: no personal motorized passenger device shall be operated:
(1) Without being equipped with a braking system;
(2) Without the rider wearing a helmet;
(3) In a careless or reckless manner as to endanger the safety of any person or the property of any person; and
(4) Without complying with applicable federal, state and local laws and regulations.
B. The authorizing official is further authorized to impose such other restrictions and limitations as deemed appropriate or necessary to protect the public safety, interest and welfare. All persons using Town property pursuant to a grant of permission shall comply with the restrictions and limitations referenced herein or imposed pursuant hereto.
§ 98-3. Enforcement and penalties.
In addition to any other enforcement or penalty allowed under state law or Town bylaw, violation of this chapter may be enforced by non-criminal disposition, by any police officer or traffic director in the manner provided by MGL c. 40, § 21D, and Chapter 1, Article I of this Code.

B. No person may ride as a passenger in or upon a motorized scooter or pocket motorcycle on any public street or sidewalk.
C. Any person who violates any provision of this section shall receive a citation and be fined $90. In addition to the issuance of a citation, any police officer who observes a violation of this section may take the pocket motorcycle or motorized scooter in question into the custody of the Cromwell Police Department or have it towed to a storage facility at the owner's expense, to be held until such time as adequate arrangements are made by a responsible adult for it to be transported to an appropriate location. If no such arrangements are made within 72 hours, said pocket motorcycle or motorized scooter shall be deemed to be abandoned. |

Chapter 500
ARTICLE II, Segways
[Adopted 12-21-2004 by Ord. No. 12-2004 (Sec. 3-14A of the 1997 Revised General Ordinances)]
§ 500-3. Findings.
The City Council of the City of Cape May finds that the unregulated operation of personal assistive mobility devices more commonly known as "Segways" as defined by N.J.S.A. 39:4-14.10(1)(a) within the City is a hazard to pedestrians and vehicular traffic in and around the streets, highways, and sidewalks of the City so as to constitute a nuisance and detract from the peaceful enjoyment of the residents and visitors to the City, and will otherwise create unnecessary risks involving the health, safety and welfare of the residents and visitors of the City.
§ 500-4. Renting prohibited.
It shall be unlawful to engage in the business of leasing or renting Segways for use upon any public streets, highways, sidewalks or any other public property within the City.
§ 500-5. Operation.
The operation of Segways is permitted within the City; provided, however, that the operation of a Segway by any person within the City shall be strictly limited to designated bicycle paths and private property. The operation of Segways upon any public streets, highways, sidewalks or any other public property within the City is strictly prohibited. |

Chapter 81
POCKET BIKES AND MOTORIZED SCOOTERS

§ 81-1. Definitions.
All terms used in this chapter shall be interpreted in accord with the definition thereof set forth in Title 14 of the Connecticut General Statutes as the title may be amended or recodified from time-to-time, except that the following defined terms shall have the meanings indicated herein:
MOTOR SCOOTER -- A wheeled device other than a motor vehicle consisting of a platform of metal, wood, plastic or any other material designed for recreation purpose to carry its user in an erect position and which is propelled by the use of a small motor. The term "motorized scooter" shall not be construed to include either:

B. A Segway or any similar device used to provide transportation for any person who possesses a valid motor vehicle operator's license.

If no such arrangements are made within 72 hours, said pocket motorcycle or motorized scooter shall be deemed to be abandoned. |

Chapter 192
ARTICLE XXVI, Pocket Bikes
[Added 1-11-2005 by Ord. No. 3284]
§ 192-138. Pocket bikes prohibited in certain areas.
No person shall drive a pocket bike on any public street, road, highway or property in the Township of Irvington.
§ 192-139. Violations and penalties.
Any person found violating § 192-138 above shall cause the following to occur: the pocket bike may be subject to confiscation by the local authorities, and the person subject to a penalty as set forth in Chapter 1, General Provisions, Article III, Penalties.
§ 192-140. Definitions.
As used in this section, the following terms shall have the meanings indicated:
POCKET BIKE -- Any vehicle powered by two-stroke gas engines or electric motors that can be recharged by plugging them into wall sockets. Furthermore, they can be scaled-down motorcycle-type vehicles which fail to meet certain safety regulations such as headlight height from the ground, taillights, brake lights, etc.

Chapter 149
PERSONAL ASSISTIVE MOBILITY DEVICES AND ELECTRIC-POWERED SCOOTERS
[HISTORY: Adopted by the Board of Commissioners of the Township of Long Beach 4-1-2005 by Ord. No. 05-04C. Amendments noted where applicable.]
§ 149-1. Operation prohibited in certain areas.
The operation of assistive mobility devices as those devices are defined in § 1 of P.L. 2001, c. 430 (N.J.S.A. 39-4-14.10) and the operation of electric-powered scooters, either with or without seats, is hereby prohibited in the Township of Long Beach on any sidewalk, bicycle path, public parking lot or any other public property or any public street.
§ 149-2. Violations and penalties; impoundment.
A. Any person apprehended operating an electric-powered scooter, either with or without seats, or an electric personal assistive mobility device shall, on the first offense, be fined not less than $100 nor more than $250; for a second offense shall be fined not less than $250 nor more than $500, and for a third offense be fined not less than $500 nor more than $1,000.
B. The electric-powered scooter or the electric personal assistive mobility device operated by any person violating the terms of this chapter may be impounded by the Police Department for a period of not more than 15 days for the first offense, not more than 30 days for the second offense, and not more than 90 days for the third offense.
§ 149-3. Exceptions.
The prohibitions hereinabove imposed in §§ 149-1 and 149-2 shall not apply to any person who is the holder of a personal identification card issued by the Township of Long Beach Police Department showing that the holder thereof is entitled to the benefits afforded by the laws of the United States and the State of New Jersey to handicapped persons dealing with the operation of motor vehicles. The Police Department of the Township of Long Beach shall be and is hereby authorized to issue such identification cards under the following conditions:
A. The applicant for such a card shall fill out an application form to be developed by the Police Department of the Township of Long Beach and submit the same to an officer designated in that Department by the Chief to issue such permits. The applicant shall submit with the application two passport-type photographs along with a check in the amount of $25 made payable to the Township of Long Beach and a copy of either:
(1) His or her motor vehicle registration showing that he or she is entitled to handicapped privileges; or
(2) A letter from his or her physician addressed to the Chief of Police of Long Beach Township unequivocally stating that the applicant is entitled, if the applicant is not the possessor of an automobile registration showing handicap privileges to secure such registration or handicap motor vehicle ownership.
B. Within 10 days of the submission of such an application in completed form, the Police Department of Long Beach Township shall issue a photographic identification card authorizing the holder to operate personal assisted mobility devices and electric-powered scooters either with or without seats in the Township of Long Beach notwithstanding the provisions of this chapter of the Ordinances of Long Beach ownship.
C. The exemptions created to the restrictions in this chapter above stated in §§ 149-1 and 149-2 shall not apply to the operation of such vehicles on Long Beach Boulevard in any section of Long Beach Township and the prohibitions contained in §§ 149-1 and 149-2 shall continue in full force and effect on that roadway.
