Is your community planning a concert or festival that will involve music?
U.S. copyright law protects musical works by granting the author exclusive
rights to use or authorize use of their works. It is a municipality's responsibility
to obtain rights to use copyright protected materials for public performances.
Until recently, it could be burdensome
for a local government to obtain licenses from the American Society of
Composers, Authors and Publishers (ASCAP). The old system required
each potential use of music to be licensed. One overlooked performance
could leave a municipality open to law suits.
A new agreement negotiated by the International
Municipal Lawyers Association (IMLA) simplifies the process!
With the new ASCAP License Agreement for Local
Governments, there is only one license to obtain, with one annual fee
(based on population), and one annual report. Obtaining the license, a
municipality gains access to, and the right to perform, any of the more
than 8 million works of the more than 110,000 ASCAP members.
The ASCAP License Agreement for Local
Governments gives municipal event coordinators peace of mind.
There is no more worry about copyright infringement,
and it allows them to concentrate on more important things - like where
to put the cotton candy!
