Be it enacted by the Town Board of the Town of Metro as follows:

Section 1. Section 62-2 of Chapter 62, Driveways, of the Code of the Town of Metro is hereby amended to read as follows:

§ 62-2. Permit required.

No person shall construct, reconstruct, repair, alter or grade any portion of a driveway, apron, ramp, motor vehicle way or other way of passage for vehicles or pedestrians lying or being between a sidewalk and the street parallel with said sidewalk or, in the absence of a sidewalk, within a distance of six feet of any adjoining street without first obtaining a permit from the Town Clerk as provided by this chapter.

Section 2. Chapter 62, Driveways, of the Code of the Town of Metro is hereby amended by adding a new section following § 62-5, to be known as § 62-5.1 as follows:

§ 62-5.1. Permit application fees.

At the time application is made for a permit required by the provisions of this chapter, an application fee of $ 5 shall be paid to the Town Clerk.

Section 3. Subsection C of § 62-8, which requires the installation of a driveway culvert by the property owner, is hereby deleted and repealed.

Section 4. Severability.
The provisions of this local law are declared to be severable, and if any section, subsection, sentence, clause or part thereof is, for any reason, held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of any remaining sections, subsections, sentences, clauses or part of this local law.

Section 5. Effective date.

This local law shall take effective immediately upon filing with the Secretary of State.
