Stacks of paper, toppling boxes and bulging file cabinets, and you've been tasked with finding the document the Board member just requested for tonight's meeting. A system of records management and retention, including schedules for retention and destruction, is crucial to effective government operation and efficient use of staff time. It is further the responsibility of municipalities to protect records against the destructive effects of disaster and to make records available when needed. Available sample legislation allows for optical disk storage of records, where records stored optically are considered to be the original records. If your municipality could benefit from a clear procedure for records management, consider reviewing sample legislation which includes a procedure for disposal or destruction of records, retention schedules, criteria for permanent storage, guidelines for a records storage center and media for record storage. |

Chapter 92 RECORDS MANAGEMENT [HISTORY: Adopted by the Town Board of the Town of Thompson 11-1-1994 as L.L. No. 6-1994. Amendments noted where applicable.] § 92-1. Establishment; department officer. There shall be a records management program established under the aegis of the Town Board headed by a records management officer (RMO). The officer will be responsible for administering the noncurrent and archival public records and storage areas for the town in accordance with local, state and federal laws and guidelines. The RMO shall be the Town Clerk or his designee. § 92-2.
Powers and duties.
(1) Obsolete and
unnecessary records according to New York State Records Retention and
Disposition Schedules thereby subject to disposition;
§ 92-3. Records Advisory Board. There shall be a Records Advisory Board designated to work closely with and provide advice to the records management officer. The Board shall consist of the Town Board, Town Attorney and Town Comptroller. The Board shall meet periodically and have the following duties:
§ 92-5. Replevin; recovery of records. The Legal Department may take steps to recover local government records which have been alienated from proper custody and may, when necessary, institute actions of replevin. § 92-6. Disposal of records. No records shall be destroyed or otherwise disposed of by a department of the town unless approval has been obtained from the records management officer. No records shall be destroyed or otherwise disposed of by the records management officer without the express written consent of the department head having authority. § 92-7. Definitions. As used in this chapter, the following terms shall have the meanings indicated:
ARCHIVES -- Those official records which have been determined by the officer and Advisory Committee to have sufficient historical or other value to warrant their continued preservation by the local government. § 92-8. When effective. This chapter shall take effect immediately upon its being enacted and the filing of a copy hereof is required by law. |

§ 28-8. Fees.
Except when a different fee is otherwise prescribed by law:
(1) Inspection of records;(2) Search for records; or
(3) Any certification pursuant to this article.
(1) The fee for copying records shall not exceed $0.25 per page for photocopies not exceeding nine inches by 14 inches.(2) The fee for copies of records not covered by Subsection C(1) shall not exceed the actual reproduction cost, which is the average unit cost for copying a record, excluding fixed costs of the village such as operator salaries.

II
Retention and Disposition
§ 28-9. Adoption of Schedule MU-1.
Records Retention and Disposition Schedule MU-1, issued pursuant to Article 57-A of the Arts and Cultural Affairs Law and containing legal minimum retention periods for municipal government records, is hereby adopted for use by all municipal officers in disposing of municipal government records listed therein.
