§ 111-7. Deposit of dog feces on city property or other property. [Amended 4-4-1988 by Ord. No. 607]

  1. Definitions. For the purpose of this section, the following definitions shall apply:
    CITY PROPERTY -- Any property owned, occupied or controlled by the City of Stamford, including but not limited to parks, streets, sidewalks and grassy areas adjacent to city streets and sidewalks.

    PROPERTY OF ANOTHER -- All property within city boundaries which is not owned by the city, including but not limited to all residential and commercial property, private streets and sidewalks and the grassy areas located adjacent to such streets and sidewalks, rights-of-way and any common area of a condominium or cooperative.

  2. Owners and custodians to be responsible. Any person who owns a dog or has custody of a dog, which dog has caused its feces to be deposited upon any city property or upon the property of another, shall immediately remove such feces or cause it to be removed and shall dispose of it in a sanitary manner. A person will be considered to have disposed of feces in a sanitary manner if such person places such material in a bag or wrapper made of paper, plastic or some similar material and places it in a refuse container which is regularly emptied by the City of Stamford Department of Sanitation or some other refuse collector, or otherwise disposes of such material on their own property.

  3. Exemption.
    (1) Nothing herein shall be construed to apply to the situation where a dog is on its owner's or custodian's property or where the dog owner or custodian has the permission of the property owner.

    (2) Any dog owned by the Stamford Police Department and used for law enforcement purposes shall be exempt from the provisions of this section.

    (3) Any dog which serves as a guide dog shall be exempt from the provisions of this section while such dog is accompanying a blind person.

  4. Penalty. Any person who violates this section shall be subject to a fine of seventy-five dollars ($75.).

Curbing of Dogs

§ 67-1. Definitions.

For the purpose of this Article, the following definitionsshall apply:

DOG -- Any dog, bitch or spayed bitch.

OWNER -- When applied to the proprietorship of a dog, includes every person having a right of property in such dog and every person who has such dog in his keeping.


§ 67-2. Nuisances prohibited; disposal of feces.

No person owning, harboring, keeping or in charge of any dog shall cause, suffer or allow such dog to soil, defile, defecate on or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk or upon any private property without the permission of the owner of said property. The restriction in this section shall not apply to that portion of the street lying between the curblines, which shall be used to curb such dog under the following conditions:

  1. The person who so curbs such dog shall immediately remove all feces deposited by such dog.

  2. The feces removed from the aforementioned designated area shall be disposed of by the person owning, harboring, keeping or in charge of any dog curbed by flushing the same down a sanitary sewer system or by use of a chemical container causing disintegration. In the event that a chemical container is used, ultimate disposal must be made in accordance with Department of Environmental Resources regulations concerning solid waste disposal.


§ 67-3. Violations and penalties. [Amended 10-3-1989 by Ord. No. 921, approved 10-3-1989]

Any person who violates or who fails or refuses to comply with this Article shall be liable to pay a fine not exceeding one thousand dollars ($1,000.) or be sentenced to imprisonment for a term of not more than thirty (30) days, or both, upon conviction before any District Justice.


§ 67-4. Enforcement.

The provisions of this Article shall be enforced by the Police Department and the Local Board of Health.

§ 78-27. Nuisances. [Amended 8-7-1972; 5-7-1991]

  1. No person owning, harboring, keeping or in charge of any dog or cat shall cause, suffer or allow such dog or cat to soil, defile, defecate on or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk or upon any public property whatsoever or upon any private property without the permission of the owner of such property.

  2. Any person owning, harboring, keeping or in charge of any dog or cat which soils, defiles, defecates on or commits any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk or upon any public property whatsoever or upon any private property without the permission of the owner of such property shall immediately remove all feces deposited by such dog or cat by any sanitary method approved by the local health authority.

  3. The feces removed from the aforementioned designated areas shall be disposed of by the person owning, harboring, keeping or in charge of any such dog or cat, in accordance with the provisions of this section, in a sanitary manner approved by the local health authority.

  4. The provisions of this section shall not apply to blind persons who may use dogs as guides.

Babylon, NY

§ 106-10.1. Control of wastes; penalties for offenses. [Added 7-3-1984 by Res. No. 629]

  1. No person owning, harboring, keeping or in charge of any dog shall cause, suffer or allow such dog to soil, defile, urinate, defecate on or commit any nuisance on any common thoroughfare, sidewalk, passageway, bypath, play area, park or any place where people congregate or walk, or on any public property whatsoever, or on any private property without the permission of the owner of said property. The restriction in this section shall not apply to that portion of street lying between the curblines which shall be used to curb such dog under the following conditions:
    (1) The person who so curbs such dog shall immediately remove, in a suitable container, all feces deposited by such dog.

    (2) The feces removed from the aforementioned designated area shall be disposed of in a sanitary manner by the person owning, harboring, keeping or in charge of any dog curbed. Disposal of feces in street storm collection systems is prohibited.

    (3) The provisions of this section shall not apply to any blind person accompanied by a guide dog.

  2. Any person violating any provision of this section shall be guilty of a violation and, upon conviction thereof, shall be subject to a fine of not less than twenty-five dollars ($25.) but not to exceed two hundred fifty dollars ($250.) or ten (10) days in jail, or by both.
