ARTICLE IV
Temporary Use Permit Required for Social Events for Minors

§ 15-22. Intent.
Any premises heretofore licensed by the City of Gloucester City to sell alcoholic beverages pursuant to state law must apply for and receive a temporary use permit from the governing body of Gloucester City for the use of the premises for social events for minors (teen nights).
§ 15-23. Definitions.
As used in this ordinance, the following terms shall have the meanings indicated:
TEEN NIGHT -- Any scheduled dance or event held on the premises of a licensed plenary retail alcoholic beverage establishment and restricted to those patrons between the ages of 15 and 20.
§ 15-24. Requirements for permit; regulations; permit fee; security.
- An establishment holding a teen night may not serve, sell or otherwise deliver alcohol, in any form, on any part of the premises, including decks and parking lots, nor shall the establishment allow any alcohol to be served, sold or otherwise delivered on the teen night.
- All alcohol must be secured in a manner which shall ensure that the same shall not be either visible or accessible, and the means of securing such alcohol shall be approved by the Gloucester City Police Department, who shall have the sole and exclusive authority to either approve or disapprove the means of securing such alcohol.
- Teen nights must be designated as the same, and no patron over the age of 20 shall be allowed to enter the premises, nor shall any patron under the age of 15 be allowed to enter the premises. The establishment holding a teen night shall make provisions for assuring that the ages are confirmed. Picture identification may be required.
- In order to schedule a teen night, the premises owner must apply for a temporary use permit through the office of the City Clerk. The fee for the temporary use permit shall be $100 per licensed premises for the initial event and $25 per licensed premises per event thereafter.
- Teen nights shall be scheduled at least one month in advance and shall not have hours extending beyond one half hour before the curfew (see Chapter 39, Curfew).
- Teen nights must be approved by resolution of the Mayor and Common Council of Gloucester City. The resolution permitting minors to be in the premises otherwise licensed for the consumption of alcoholic beverages shall contain such terms and conditions that are deemed appropriate by the governing body.
- The security personnel necessary for teen nights shall be established by the Gloucester City Police Department on an individual establishment/premises basis and shall be included as part of the temporary use application.
§ 15-25. Violations and penalties.
Violations of the provisions of this ordinance may result in the imposition of a fine of not more than $1,000 per violation.

ARTICLE V
Teen Nights
§ 17-23. Purpose.
The purpose of this article is to protect the welfare of our teenage population by regulating their congregation upon premises licensed by the borough pursuant to state law to dispense alcoholic beverages.
§ 17-24. Definitions.
As used in this article, the following terms shall have the meanings indicated:
TEEN NIGHT -- A scheduled dance or event held on the premises of a licensed plenary retail alcoholic beverage establishment and restricted to those patrons under the legal drinking age established by the State of New Jersey.
TEEN-NIGHT PARTICIPANTS -- Those individuals who are younger than the legal drinking age, as established in New Jersey, who attend teen nights as hereinabove defined. This shall not apply to individuals employed by the licensed plenary retail alcoholic beverage establishment.
§ 17-25. Regulations.
The holding of a teen night shall be permitted in any duly licensed plenary retail alcoholic beverage establishment within the Borough of Seaside Heights if the following criteria apply and/or are complied with:
- All alcoholic beverages, which shall include all liquor, beer and wine, shall be locked in cabinets and storage areas. Additionally, no employee shall have access to the locked areas once the beverages are placed into said storage areas and cabinets. To ensure that no underage person shall have access to any said alcoholic beverages, the licensee shall lock all said storage areas and cabinets and shall be the only individual with a key to the same.
- No persons attending a teen night shall be permitted to bring any food or beverages onto the licensed premises in which the teen night is being held.
§ 17-26. Violations and penalties.
- Any person violating and failing to comply with any other provision of this article shall, upon conviction thereof, be punishable by a fine on no less than $100 and no more than $1,000, by imprisonment not exceed 90 days or by community service of not more than 90 days or any combination of fine, imprisonment and community service, as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
- If any owner, operator or licensee is found in violation of the provisions of this article, the alcoholic beverage license shall be subject to suspension or revocation in accordance with the applicable provisions of the New Jersey Alcoholic Beverage Control Act and this article.
- The violation of any provision of this article shall be subject to abatement summarily by restraining order or injunction issued by a court of competent jurisdiction.

ARTICLE III
Use by Minors

§ 114-18. Minors entering licensed premises.
- No minors shall enter any premises licensed for the sale of alcoholic beverages unless accompanied by his or her parent or guardian, as provided hereinafter. This shall not apply to minors who are guests at bona fide hotels, motels or restaurants, or who enter a licensed premises where food is sold for the purpose of purchasing food, or who are required to enter a licensed premises in the course of their business or occupation.
- Minors shall also be permitted to enter premises licensed for the sale of alcoholic beverage consumption, provided that the persons or entities to which the license is issued have received prior approval by formal resolution adopted by the City Council of the City of North Wildwood and have complied with the following requirements:
(1) There shall be a separate entrance and exit for minors if portions of the licensed premises are otherwise used for the sale and/or consumption of alcoholic beverages.
(2) There shall be no alcohol served in the area where minors are permitted or to which such minor would have access. Any alcohol stored in the area where minors are permitted or to which such minors shall have access shall be secured in a manner which shall ensure that the same shall be neither visible or accessible, and the means of securing such alcohol shall be approved by the Chief of Police of the City of North Wildwood or his designee, who shall have the sole and exclusive authority to either approve or disapprove the means of securing such alcohol.
(3) The premises shall pass an inspection by the Chief of Police of the City of North Wildwood or his designee to ensure that the premises are satisfactory for entrance and use by minors.
(4) The resolution permitting minors to be in the premises otherwise licensed for the consumption of alcoholic beverages shall contain such terms and conditions as are deemed appropriate by the City Council of the City of North Wildwood.
§ 114-19. Purchase and possession by minors.
It shall be unlawful for a minor to purchase, attempt to purchase or have purchased for him or her, or have in his or her possession, any alcoholic beverage.
§ 114-20. Purchasing for minors.
It shall be unlawful for anyone to purchase for or attempt to purchase for, or furnish or attempt to furnish to, a minor any alcoholic beverage; provided, however, that this section shall not apply to licensees, officers or employees of licensees in such cases where such licenses, officer or any employee thereof is engaged in the operation of the licensed premises.
§ 114-21. Misrepresenting age.
It shall be unlawful for any minor to misrepresent or misstate his or her age for the purpose of inducing any licensee or employee or officer of the licensee to sell, serve or deliver alcoholic beverages to said minor.

Any person violating any provision of this article shall, upon conviction, be punishable by a fine not to exceed $1,000 or imprisonment for a term not to exceed 90 days, or both.
