This software, including all of its features, graphic design and content (the "Software"), is a service made available by General Code, LLC (“General Code”) and all content, designs, information, services ordered or provided on or through this Software ("Content") may be used solely under these Terms and Conditions of Use.
As a user of this Software you are granted a nonexclusive, nontransferable, revocable, limited license to access and use this Software and Content in accordance with these Terms and Conditions of Use. General Code may terminate this license at any time for any reason.
The on-line and archived municipal codes (“E-Codes”) and/or any other documents that appear on this Software may not reflect the most current legislation adopted by the municipality. General Code provides E-Codes for informational purposes only. E-Codes should not be relied upon as the definitive authority for local legislation. Additionally, the formatting and pagination of E-Codes varies from the formatting and pagination of the official copy. The official printed copy of a code of ordinances should be consulted prior to any action or decision being taken.
For further information regarding the official version of the code of ordinances or other documents posted on this Software, please contact the municipality directly. The Content may contain typographical errors or other errors or inaccuracies and may not be complete. General Code reserves the right to correct any errors, inaccuracies or omissions and to change and update this Content at any time without prior notice. General Code does not, however, guarantee that any errors, inaccuracies or omissions will be corrected.
Content is not intended to and does not constitute legal advice and no attorney-client relationship is formed. The accuracy, completeness, adequacy or currency of the Content is not warranted or guaranteed. Your use of Content on this Software is at your own risk.
You are solely responsible for any Content that you create, post, store or display on this Web Site (a “User Generated Content”) and for ensuring that your User Generated Content does not violate the rights of any third party. Content is subject to change or termination without notice in the editorial discretion of General Code. All rights not expressly granted herein are reserved to General Code and the municipalities.
The Content on this Software is for your personal use only and not for commercial exploitation. You may not decompile, reverse engineer, disassemble, rent, lease, loan, sell, sublicense, or create derivative works from this Software or the Content. You may not copy, modify, reproduce, republish, distribute, display, or transmit for commercial, non-profit or public purposes all or any portion of this Software, except to the extent permitted by these Terms and Conditions of Use.
When using this Software, information will be transmitted over a medium that may be beyond the control and jurisdiction of General Code. Accordingly, General Code assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of this Software.
The Software and the content are provided on an "as is", “as available” basis. TO THE FULLEST EXTENT PERMITTED BY LAW, GENERAL CODE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. Without limiting the foregoing, General Code makes no representations or warranties about the accuracy, reliability, completeness, currentness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of this Software.
In no event shall General Code or any third parties mentioned on this Software be liable for any damages (including, without limitation, actual, indirect, incidental, punitive or consequential damages, lost profits, or damages resulting from lost data or business interruption) arising from the use of or inability to use this Software or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not General Code or any third parties mentioned on this Software are advised of the possibility of such damages. To the extent this limitation of liability is prohibited or fails in its essential purpose, General Code’s sole obligation shall be to pay actual damages incurred by you, not to exceed $1,000.
General Code may provide links to third-party websites. General Code does not recommend and does not endorse the content on any third-party websites. General Code is not responsible for the content of linked third-party websites or websites framed within this Software and does not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such websites.
You agree to defend, indemnify, and hold General Code, its officers, managers, members, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal fees, resulting from, or alleged to result from, your violation of these Terms and Conditions of Use.
You expressly agree that exclusive jurisdiction for any dispute with General Code, or in any way relating to your use of the Software, resides in the courts of the State of New York and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of New York in connection with any such dispute including any claim involving General Code or its affiliates, subsidiaries, employees, contractors, officers, managers, members, telecommunication providers, and content providers.
These Terms and Conditions of Use are governed by the laws of the State of New York, without respect to any conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
If you believe any materials accessible on or from this Software infringe your copyright, you may request removal of those materials (or access thereto) from this Software by contacting General Code's copyright agent (identified below) and providing the following information:
- Identification of the copyrighted work that you believe to be infringed. Please describe the work, and where possible include a copy or the location (e.g., URL) of an authorized version of the work.
- Identification of the material that you believe to be infringing and its location. Please describe the material, and provide us with its URL or any other pertinent information that will allow us to locate the material.
- Your name, address, telephone number and (if available) e-mail address.
- A statement that you have a good faith belief that the complained of use of the materials is not authorized by the copyright owner, its agent, or the law.
